Sky Italia ad case returns to court

Sky Italia has announced that by law the Lazio court will have to decide whether the current advertising limit imposed only to the pay-TV is lawful, as underlined by the European Court of Justice.
This comes despite the fact that the European court said that making a distinction between pay and FTA is not ipso facto a violation of European law.
“It is for the national court to decide whether it is legitimate to have a lower ceiling on pay-TV operator and Sky is confident that the court in Lazio will welcome our reasoning,” commented the pay-TV broadcaster.
