Ofcom shuts adult website with first Section 368K

Ofcom has revealed an enforcement action it has taken against a VoD adult service “Jessica Pressley.”
The website, which provided free-to-view pornographic content without a robust paywall, was referred to Ofcom by the Authority for Television on Demand (ATVOD) – which is responsible for regulating the editorial content of certain on-demand programmes services.
On October 7th, Ofcom issued the service provider, JP Media, with a Direction to suspend its service, using powers under Section 368K of the Communications Act for the first time. The Direction took immediate effect and continues for an indefinite period. Failure to observe the Direction is a criminal offence. The service is now no longer available on the internet.
Ofcom said the action demonstrates that failures to co-operate with them on issues concerning the protection of children will be dealt with swiftly.
